Terms of Use

Article 1 — Purpose

These Terms of Use (ToU) define the terms of access and use of the Chingu Cards platform, accessible at www.chingucards.com, published by VUE D'AILLEURS.

Article 2 — Access to the platform

2.1 Access conditions

Access to the platform is open to any adult individual or duly constituted legal entity. Browsing the platform is free and open. Some features require creating an account.

2.2 Availability

Chingu Cards strives to ensure the platform is available 24/7. However, interruptions may occur for maintenance or force majeure reasons. Chingu Cards cannot be held responsible for service interruptions beyond its control.

Article 3 — Account creation

3.1 Registration

To access all features, the user must create an account by providing:

• A valid email address
• A secure password
• The information required according to their profile (buyer/seller)

3.2 Account uniqueness

Each user may only have one active account. Creating multiple accounts is strictly prohibited.

3.3 Accuracy of information

The user guarantees the accuracy of the information provided and undertakes to keep it up to date.

Article 4 — Rules of use

4.1 Prohibited behaviour

It is strictly prohibited on the platform to:

• Post false or misleading listings
• Sell counterfeits or unauthorised items
• Harass, threaten or insult other users
• Attempt to bypass the platform's payment system
• Create fake accounts or impersonate others
• Use bots, scripts or any other automated tool
• Collect other users' personal data without consent

4.2 Listing content

Published listings must:

• Correspond only to K-pop photocards
• Include real and representative photos
• Contain an honest and accurate description
• Respect intellectual property rights

Article 5 — Intellectual property

5.1 Platform content

All elements constituting the Chingu Cards platform (logo, design, texts, features) are the exclusive property of VUE D'AILLEURS and are protected by intellectual property law. Any reproduction, representation or use without prior authorisation is strictly prohibited.

5.2 User content

By publishing content on the platform (photos, descriptions), the user grants Chingu Cards a non-exclusive licence to use it for the operation and promotion of the platform. The user guarantees to hold the rights to the published content.

Article 6 — Liability

6.1 Chingu Cards' liability

Chingu Cards acts as a technical intermediary and cannot be held responsible for:

• The content of listings published by sellers
• The quality or conformity of items sold
• Disputes between buyers and sellers
• Losses or damages related to delivery

6.2 User liability

The user is solely responsible for their use of the platform and the content they publish.

Article 7 — Suspension and termination

Chingu Cards reserves the right to suspend or terminate any user's access to the platform in the event of:

• Violation of these ToU
• Fraudulent behaviour
• Non-payment of commissions due
• Repeated reports from other users

Suspension may be immediate in the event of serious misconduct, without notice or compensation.

Article 8 — Modification of the ToU

Chingu Cards reserves the right to modify these ToU at any time. Users will be informed of changes by email or notification on the platform.

Article 9 — Applicable law

These ToU are governed by French law. Any dispute relating to their interpretation or performance will be submitted to the competent French courts.
