Terms of Sale

Article 1 — Platform presentation

Chingu Cards is a marketplace specialising in buying and selling K-pop photocards, published by VUE D'AILLEURS, a SAS with capital of €7,500, registered under SIRET number 488 438 532 00013, with its registered office at 19 rue des Moines, 75017 Paris, France.

The platform connects private and professional sellers with buyers wishing to acquire new or used K-pop photocards. Chingu Cards acts as a technical intermediary and is not the direct seller of the items offered on the platform.

Article 2 — Scope

These Terms of Sale (ToS) apply to all transactions carried out on the Chingu Cards platform between sellers and buyers. Any purchase made on the platform implies full acceptance of these ToS by the buyer and seller. These ToS prevail over any other document, unless otherwise agreed in writing by Chingu Cards.

Article 3 — Registration and user account

3.1 Registration conditions

• Registration is open to individuals aged at least 18 or duly registered legal entities.
• The user must provide accurate, complete and up-to-date information when registering.
• Only one account is allowed per individual or legal entity.

3.2 Account security

• The user is solely responsible for the confidentiality of their login credentials.
• Any activity carried out from an account is deemed to be performed by its holder.
• In the event of account compromise, the user must immediately contact Chingu Cards at contact@chingucards.com.

3.3 Account suspension and deletion

Chingu Cards reserves the right to suspend or delete any account in the event of:

• Non-compliance with these ToS
• Fraudulent or abusive behaviour
• Provision of inaccurate information

Article 4 — Listing items for sale

4.1 Authorised items

Only K-pop photocards are authorised for sale on the platform, whether new or used.

4.2 Seller obligations

The seller undertakes to:

• Describe each item for sale accurately and honestly
• Provide real and representative photos of the item
• Clearly indicate the condition of the item (new, very good, good, fair)
• Only offer for sale items that they legitimately own
• Not sell counterfeit, illegal items or items infringing third-party rights

4.3 Seller liability

The seller is solely responsible for the content of their listings and the conformity of the items sold with their description. Chingu Cards cannot be held responsible for inaccuracies or omissions in the published listings.

Article 5 — Purchase process

5.1 Order

The buyer selects the desired item and proceeds to order via the platform. The order is confirmed after payment validation.

5.2 Price

• Prices are displayed in euros (€) including all taxes
• Shipping costs are borne by the buyer and are indicated before order validation
• Prices may vary depending on sellers, as Chingu Cards does not intervene in price setting

5.3 Payment

Payments are secure and processed via the payment methods available on the platform. Chingu Cards uses certified payment systems guaranteeing transaction security.

Article 6 — Commissions and fees

Chingu Cards charges a commission between 8% and 10% on each sale made via the platform. This rate is determined according to Chingu Cards' commercial policy and is visible on the platform. This commission is automatically deducted from the sale amount before payment to the seller.

Article 7 — Delivery

7.1 Delivery responsibility

Delivery is entirely managed and provided by the seller. Chingu Cards does not intervene in the shipping process.

7.2 Shipping time

The seller undertakes to ship the item within a maximum of 7 calendar days following order confirmation.

7.3 Delivery zones

Sellers may offer national and international delivery. Available delivery zones are specified in each listing.

7.4 Shipping costs

Shipping costs are borne by the buyer and are clearly indicated before order validation.

7.5 Liability in case of loss or damage

Chingu Cards cannot be held responsible for loss, theft or damage occurring during delivery. Responsibility lies entirely with the seller. Sellers are strongly advised to use a shipping service with tracking number and, where applicable, parcel insurance for valuable items. In the event of a dispute related to delivery, the buyer must contact the seller directly.

Article 8 — Right of withdrawal

In accordance with applicable regulations, the buyer has a period of 14 days from receipt of the item to exercise their right of withdrawal, without having to justify their decision. To exercise this right, the buyer must notify their decision to the seller via the platform's internal messaging. Return costs are borne by the buyer, unless otherwise agreed with the seller.

Article 9 — Claims and disputes

9.1 Claims

Any claim must be addressed as a priority to the seller via the platform's internal messaging. In case of non-resolution, the buyer can contact Chingu Cards customer service at contact@chingucards.com.

9.2 Proof in case of damage or non-conformity

For any dispute relating to the condition of a received item, the buyer is strongly encouraged to film the entire unboxing of the parcel upon receipt, without interruption or cuts. This video must show the external condition of the parcel on arrival, its opening in real time, the protective packaging as well as the exact condition of the card upon discovery. It constitutes the most reliable evidence and will be decisive in arbitrating the dispute. Without such a video, the buyer risks their claim not being upheld, as photographs alone do not establish with certainty the receipt conditions of the parcel. The buyer is invited to keep this video until confirmation that the item is compliant.

9.3 Dispute resolution

In the event of a persistent dispute, the parties may resort to an amicable mediation procedure before any legal action.

9.4 Applicable law

These ToS are subject to French law. In the event of a dispute, the French courts will have jurisdiction.

Article 10 — Modification of the ToS

Chingu Cards reserves the right to modify these ToS at any time. Users will be informed of any modification by email or notification on the platform. Continued use of the platform after modification constitutes acceptance of the new ToS.
